These Terms govern access to and use of ListTrash. By creating an account or using the service, you agree to these Terms and the Privacy Policy.

Who may use ListTrash

You must be legally able to agree to these Terms and eligible for the ListTrash features you access. You agree to provide accurate account and employee-identification information and to keep it current. ListTrash may verify eligibility against available roster or employment-related information.

Your account

You are responsible for protecting your password and for activity under your account. Do not share an account, impersonate another person, or attempt to obtain a new trial by changing an account, email address, employee number, or payment profile. Notify ListTrash promptly if you believe your account has been compromised.

Not an official railroad source

ListTrash is an independent third-party service. It is not affiliated with or endorsed by the MTA, Long Island Rail Road, an employer, or a labor organization. Schedules, assignments, awards, pay calculations, operational information, AI suggestions, and notifications may be incomplete, delayed, or incorrect. Verify information through the Crew Dispatcher or other official source. Do not rely on ListTrash for safety-critical or time-critical railroad decisions.

Acceptable use

You agree not to:

use ListTrash unlawfully, fraudulently, or to harm another person;
scrape, bulk-download, republish, sell, or improperly distribute roster, coworker, or operational information;
probe, bypass, disable, or interfere with security, access controls, subscriptions, rate limits, or service operation;
upload malicious code or content you do not have the right to use; or
reverse engineer or copy protected portions of ListTrash except where applicable law expressly permits it.

Your content

You retain ownership of content you enter or upload. You give ListTrash a limited license to host, process, copy, and display that content only as reasonably needed to provide, secure, maintain, and improve the service. You are responsible for your content and for ensuring you have the right to use it. Avoid entering unnecessary sensitive personal information about yourself or others.

ListTrash content and software

ListTrash and its software, design, branding, and original content are protected by applicable intellectual property laws. These Terms permit personal access to the service; they do not transfer ownership of ListTrash or authorize commercial reuse of its protected material.

Subscriptions and third-party services

Paid access is also governed by the Subscription Terms. Some features depend on third-party services, including payment, hosting, analytics, email, notification, and AI providers. Their availability and separate terms may affect those features.

Changes, availability, and termination

ListTrash may add, change, suspend, or discontinue features and may limit or terminate access when reasonably necessary for security, legal compliance, nonpayment, misuse, or a violation of these Terms. You may stop using ListTrash or delete your account at any time. Provisions that by their nature should continue after account closure will survive.

Disclaimers

To the maximum extent permitted by law, ListTrash is provided “as is” and “as available,” without warranties of uninterrupted availability, accuracy, fitness for a particular purpose, or non-infringement. Nothing in these Terms excludes a warranty or right that applicable law does not allow to be excluded.

Limitation of liability

To the maximum extent permitted by law, ListTrash will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost pay, data, profits, opportunities, or goodwill arising from use of or inability to use the service. ListTrash's aggregate liability relating to the service will not exceed the amount you paid to ListTrash during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.

Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except where applicable law requires otherwise.

Changes to these Terms

ListTrash may update these Terms as the service changes. The date above shows the latest revision. Material changes will be communicated, and consent will be requested when required by law.
